The Madras High Court vide order dated 11-10-2023 in Company Application No. 533 of 2023 directed the Official Liquidator to publish the advertisement for calling for claims in one issue of All India Edition of English Newspaper “The Hindu” daily and in one issue of respective state vernacular language newspapers for calling upon all creditors/investors/unregistered customers to file their claims before the Official Liquidator, Chennai on or before 02/01/2024. However, those who missed this deadline, can still approach the High Court to condone the delay in filing the claims.

Question 1) Who can file claim?

Answer: Only unregistered customers and unsecured creditors can file claims.


Question 2) Who is an unregistered customers and registered customers?

Answer: Unregistered customers are those who invested in Maxworth Orchards (India) Limited for whom Sale Deed were not registered or executed by the company for their investments in the land of their respective projects.

Registered customers are those who invested in Maxworth Orchards (India) Limited for whom Sale Deed were registered and executed by the company for their investments in the land of their respective projects.

 

Question 3) Who are not eligible to file claim?

Answer:  Registered customers are not eligible to file a claim as per order of Hon’ble High Court in C.A. No. 1334 OF 2003 dated 13-10-2003. (Give Hyper Links)



  • Question 5) What documents should I submit?
  • Answer: The original Form - 66 along with xerox copies of Maintenance agreements, Receipts & Statement of Accounts issued by Maxworth Orchards (India) Limited should be submitted

 

  • Question 6) To whom should the claim be submitted?

Answer: The filled Form – 66 should be submitted to the following address “The Official Liquidator, High Court, Madras, Office of the Official Liquidator, Corporate Bhavan, 2nd Floor, No. 29, Rajaji Salai, Chennai – 600 001”. It can be sent by registered post with acknowledgement due.

Instruction to file Form- 66 to make a claim before the Official Liquidator High Court of Madras by Unsecured Creditors /Unregistered Customers.

 

  • The Unsecured Creditors / Unregistered Customers can make claim in an affidavit proving the debt or claim in the prescribed - Form – 66 of Companies (Court) Rules 1959 (See rule 151).
  • The investors who had paid money to Maxworth Orchards (India) Limited should sign the affidavit of proof of debt in the prescribed Form - 66 after filling up the details of investment made by the them.
  • The affidavit of proof of debt in the prescribed Form – 66 duly stamped and notarized with their respective names, address and particulars of debts or claim.
  • The original Form - 66 along with xerox copies of Maintenance agreements, Receipts & Statement of Accounts issued by Maxworth Orchards (India) Limited should be submitted to the following address: -

The delay in filing the Form - 66 the investors / creditors will have to be condoned by Hon’ble High Court at Madras. The Investor/Customer will have to file a Company Application for condoning the delay in Hon’ble High Court of Madras.


The original receipts, Maintenances Agreement & Statement of Account will have to be submitted to the Official Liquidator office only after the Official Liquidator calls for the same after verification of Form 66.
